
The
goal of our Foreclosure Department is to provide the real estate lending
community with means to successfully
protect
and recover their investments in accordance with the law, while maintaining
the utmost professional and ethical standard with respect to the defaulted
borrower. This is achieved by commencement of the non-judicial foreclosure
process prescribed by California Law.
A
non-judicial foreclosure is used to enforce the “power of sale”
clause of a deed of trust. A "power of sale" clause is the
borrowers’ agreement to the sale of the securing property in the
event of their default. A default is essentially the borrowers’
failure to carry out the terms of the note and deed of trust as agreed.
This includes, but is not limited to, the following breaches:
Our
staff has been processing foreclosures since 1988 and we have never
had a trustee's sale "set aside" because of procedures. We
are able to conduct foreclosures on real property located anywhere in
the State of California. As
active members of the United Trustee's
Association (formerly California Trustee's Association), we stay
constantly updated on the changes occurring in the California Civil
Code as well as current case law, both of which govern non-judicial
foreclosures.
We
have the knowledge, skills, and experience to handle the most difficult
foreclosures in an efficient and timely manner. When choosing a trustee,
keep in mind that the process is the same for all and that all fees
are regulated by State law. The difference comes in the service the
lender will receive. Service is in our name and service is what we will
provide.
